Terms & Conditions
Definitions used in these Terms and Conditions:
 "Buyer"  or 'You' means the person and/or organization who buys or agrees to buy the Goods from the Supplier.
"Supplier" or 'We' means Onske Interiors Ltd, 71-75 Shelton Street, London, WC2H 9JQ. A  company registered in England and Wales with company number 08945211 and whose VAT number is 211977506.
"Goods" "Items" or “Products” means the items that the Buyer agrees to buy from the Supplier;
"Terms and Conditions" means these terms and conditions but will also include any special terms and conditions as agreed in writing with the Buyer by the Supplier.
"Website" means www.onske.co.uk
 “Working Days” means any Monday to Friday from 9am to 5.30pm GMT excluding all Public and bank holidays in England and Wales
The following terms and conditions apply to all transactions that take place on www.onske.co.uk website.
 "Contract" means the contract between the Supplier and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
“Made to Order Goods” mean custom made items modified to the Buyer’s own specification and choice of finish.
 
General

These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age.

Goods are supplied to all Buyers for domestic use only as per these terms and conditions. It is at the Buyers sole discretion as to where they place the goods and how they use the goods after delivery and the Supplier cannot be held responsible for goods placement after delivery has been received by the Buyer.

The use of the 'website' and placement of an order indicates your acceptance of these terms and conditions.
These Terms and Conditions apply to all contracts for the sale of Goods by the Supplier to the Buyer and will prevail over any other communication, agreement or documentation from the Buyer.


The Supplier may choose not to accept an order for any reason whatsoever without liability.We will treat each order for goods as an offer to purchase goods subject to these terms and conditions.

Please read these terms carefully or print a copy for your future reference.

1. Warranty
1.1.All goods are covered by a 1 Year manufacturers warranty. The manufacturer guarantee is that the materials and workmanship of the Goods will be free from defects for a period of one year from the date that the Goods were received by the Buyer from the Supplier. The warranty does not cover normal wear and tear. Please check your product upon delivery. If an item is visually damaged upon delivery, it must be signed for as ‘damaged’. If you cannot check an item please sign as 'unchecked' as otherwise you are signing that you have received an item in satisfactory condition. The warranty starts on the day of receipt of the product.
 1.2  We will require photographic evidence of any damaged goods before we can  discuss a repair or replacement. Please email us as soon as possible with photos of product and packaging it arrived in, showing any damage from different distances and angles and perspective, so we can ascertain the issue in relation to both item and packaging.
1.3 The warranty does not include buttons on sofas or chairs as they have a tendency to catch so are not associated to any manufacturing defect.
1.4 This guarantee specifically excludes faults caused by accident, neglect, and misuse, any subsequent mechanical, chemical, electrolytic or other damage after risk has passed to the Buyer, which is not due to a defect in the Goods.
1.5 Under Commercial Use Warranty, any goods(s) supplied by Onske Interiors Limited which are not used exclusively in a private and domestic environment will not be covered by any warranty or guarantee, as goods are supplied to all Buyers for domestic use only as per these terms and conditions. Any warranty will be rendered void in the event that purchased goods are used, for any period of time, in a commercial or public environment.
1.6 Goods will be repaired in the first instance or replaced if deemed necessary after inspection, should the product develop a manufacturers fault within twelve months from the date of purchase. Should your product develop a fault within the first fourteen days of purchase you many return your goods for a full refund providing you return the goods in the same condition as supplied and with the original box and packaging.

This does not affect any statutory rights that you may have. This guarantee specifically excludes faults caused by accident, neglect, and misuse and excludes goods supplied and used under conditions 1.5 as stated in previous paragraph.

2. Cancellation of Orders / Returning Goods

 2.1 You have the right to cancel your order within 7 working days from date of delivery for a full credit or refund less any applicable delivery charges. Goods returned outside this 7 day period will be subject to a restocking fee of 10%.

2.2 It remains your responsibility to return any such items in a pristine saleable condition in their original box and packaging. You will be responsible for the return of the goods with adequate insurance during the return journey. Goods received back incomplete, damaged or in any condition other than saleable will be returned to you. Any returning items not in pristine and as new condition may be subject to a deduction off any refund due.

2.3 Prior to returning any products, please contact us. If you do not return goods within 14 days after you have informed us that you wish to cancel your order, your right to cancel will be revoked. The cancellation must be put into writing via email or post.

2.4 Made to order goods are not eligible for cancellation under distance selling legislation (CCRs). https://www.legislation.gov.uk/uksi/2013/3134/regulation/28/made 28.(1) —
the supply of goods that are made to the consumer’s specifications or are clearly personalised
Furniture made to your exact specification or colour as a bespoke order cannot be cancelled once we have accepted your order. These orders fall outside the distance selling and consumer sales regulations which states that personalised goods or goods made to a consumer’s specification are exempt.

3. Damaged Goods
 3.1 If the Buyer wishes to make a claim of defect or damage, then the Buyer must retain the original packaging. We ask that this be retained in good condition. Without the original packaging the Supplier may be unable to deal with the Buyer's complaint.
3.2 If the Supplier agrees to replace the product then they will make arrangements with the Buyer to collect the damaged or otherwise defective Goods from the Buyer and replace them. Collections will be booked in advance for a mutually agreeable date, and the Supplier will not be liable for any further costs to the buyer due to any unforeseen logistical delays or changes or delays to scheduled collection times by third party logistics.
 3.3 The supplier will examine the Goods and determine whether the defect is the fault of the Buyer or the Supplier within 14 days of their return to the Supplier. Where the fault lies with the Buyer, the Goods will be returned to the Buyer within 14 days of receipt.
 3.4 Where any fault lies with the Supplier, in relation to Goods sold, a repair or     replacement will normally be dealt with as soon as the Supplier is able to provide such, within a reasonable time frame from the date that the Buyer notifies the Supplier of a defect. However, the Supplier reserves the right to offer a refund or compensation. Refunds and compensation are normally paid within 14 days of the date of the Supplier's inspection.
3.5 Where returned Goods are found to be damaged due to the Buyer's actions then the Buyer will be liable for the cost of repairs undertaken.
3.6  Damaged goods from abnormal use, use in non-standard or commercial environments, from excess working conditions, from failure to follow instructions, misuse, alteration or unauthorised repair, wilful damage, improper maintenance or negligence will not be dealt with by the Supplier.

3.7 Risk in any Goods passes to the Buyer on delivery of those Goods to the delivery address.

4. Delivery
4.1 Delivery of stock items will normally be made within 3-7 working days from clearance of payment. The Supplier shall endeavour to deliver goods within the times stated but goods are subject to availability and delays in delivery of goods is sometimes outside of the Suppliers control. Any dates specified for the delivery of goods are approximate. The Supplier will use all reasonable endeavours to adhere to any agreed dates for delivery of Goods. The Supplier will never be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any delivery or collection date.
4.2 Delivery of most larger items via pallet service is to kerbside or doorstep only. A driver may assist further at his discretion but we cannot insist that they do so.
4.3 Pallet service deliveries are during 'Working Days' (Monday to Friday) and pallet companies do not provide one hour window times like smaller item couriers. Someone will need to be at the delivery address to sign for the goods. The Supplier will provide tracking information in advance to the Buyer. Should the Buyer not be there to take delivery there may be a charge incurred to the Buyer for any subsequent redelivery attempt by the the pallet delivery service.
4.4 For goods delivered by van service (eg marble tables), these are delivered on scheduled routes by third party logistics and they are provided with the Buyers contact details and confirm dates and times directly with the Buyer in advance. Should the Buyer not be there at the allocated time slot to take delivery and allow them to gain access, then there may be a further re-delivery charge applicable.
4.5 The Supplier is not liable for any damage to Buyers property or possessions, that may occur during the delivery process by third party logistics firms delivering goods to room of choice and/or assembling items.Any potental liability will be passed to the logistics company and the Supplier will provide the Buyer with their contact information.
4.6 Buyers must take care when opening packaging. The Supplier cannot be responsible for any damage caused as a Buyer removes packaging, for example, if the Buyer uses a knife to remove packaging and Goods are torn or a Buyer uses a heavy implement to lever off crating and damages contents inside inadvertantly.

4.7 Smaller items (ie singular dining chairs, accessories) are delivered by national courier firms and Buyers contact details are provided to them.They will provide window times for delivery directly to the Buyer. The Supplier is not liable for any losses occurred should there be unforeseen delays or rescheduling of planned deliveries by these third party logistics.
4.8  For non-standard destinations, UK islands, highlands, Northern Ireland, and outer areas destinations or for overseas destinations not listed, a further delivery surcharge may be applicable and if so the Supplier will email the Buyer promptly to notify them of any excess costs.

4.9 Items being delivered outside of the UK may be subject to import fees in certain countries, which  the Buyer will be responsible for paying.

5. Availability of Products
5.1 Products and services are subject to availability and may be withdrawn at any time. If we are unable to supply the goods for any reason within normal delivery times, we will firstly contact you as soon as possible, to notify you of any delay due to stock unavailability. We we will refund any monies already paid for such goods if requested, however, we will not be responsible for compensating you for any other losses you may suffer if we are unable to supply the goods.


5.2 Many items offered on this website are in stock and available for swift delivery. Items that are not in stock are ordered in and may take up to 12 weeks to deliver, please contact us to check availability. Custom orders are non refundable.

6. Product Information
6.1 The product specifications, images and other information published on our website have been gathered from information provided by suppliers, manufacturers, publications and public-domain sources. We always endeavour to ensure this information is accurate and amended as soon as possible. We cannot however guarantee the full reliability or the accuracy of the information contained within its pages.
6.2 Measurements, dimensions of goods are supplied by manufacturers and there is a tolerance allowed in general of between 1cm and 3cm for manufacturing processes.  Whilst we endeavour always to have the most up to date and correct product information, there may be very slight variations on fabric colours, sizing and dimensions to those listed on our website.
6.3 In the event any product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a refund in the value of the incorrect price (including delivery charges).
6.4 When the Buyer has supplied specifications or measurements for custom made items, then their accuracy remains the sole responsibility of the Buyer and the Buyer shall be solely responsible for any costs and/or expenses incurred because of any inaccuracy or problems arising as a result of any specifications and/or measurements provided.
6.5 Certain goods are manufactured in natural materials such as marble or solid wood. By nature these materials may have inherent and unique markings, for example, marble may have stronger veins of stone running through and unique markings specific to an individual piece, wood may have a specific grain or variations in staining due to the grain. These are not considered flaws in the material of the goods.
6.6 The Supplier will endeavour to provide the Buyer with  relevant product information pertaining to the goods, and this information is normally provided on the product page of the Suppliers website. It is the Buyer's responsibility to care and maintain for a product with the relevant materials, should the item require specific treatment or specific care prior to use.

7. Payment Methods
7.1 The Supplier uses Shopify as their ecommerce platform and Shopify's encrypted payment processors accept all major credit and debit cards including Visa,/Visa Debit, American Express, MasterCard, Apple Pay, Google Pay and Paypal. Your payment is captured automatically at the time of order.
7.2 Your order will only be processed and prepared for dispatch once authorisation of your credit card has been received by us via Shopify or if paying via BACs payments, once funds are cleared and in our bank account. We request that you email us for BACs payments so we can issue and email a relevant invoice to you. We do not offer any credit facilities.
7.3. Prices quoted are inclusive of UK VAT rates.
7.4 Delivery costs will be displayed and confirmed upon checkout before the order is  confirmed. For non-standard, non-UK destinations a further delivery surcharge may be applicable and if so, the Supplier will email the Buyer promptly to notify them of any excess costs.

8. Trade Marks & Regulations
8.1 Many of the designer inspired goods on our website are from designs originally construed in the early or mid 20th century. They are made to the highest quality and replicate the essence of the original designs. The names Charles & Ray Eames, Harry Bertoia, George Nelson, Arne Jacobsen, Eero Aarnio, Saarinen, Mies Van Der Rohe, Hans Wegner, Corbusier, Kjaerholm and others are only used to describe the characteristics of the goods made in the style of their designs, and not as trade marks.
8.2 Designers and resellers should note that these items should not be resold as originals nor speculate, suggest or otherwise lead anyone to believe such.
8.3 All items comply with UK fire regulations for domestic use.
 
Limitation of Liability
The Supplier shall never be liable for any indirect, incidental or consequential loss or damage whatsoever. All goods are supplied on the basis that they are for use in domestic environments only.
Time shall not be of the essence and the Supplier shall incur no liability to the Buyer in respect of any failure to deliver the Goods to the delivery address by any agreed date.
Other than those implied by law where the Buyer is dealing as a Consumer, in the event of the Supplier breaching any of these Terms and Conditions the Buyer's remedies are limited to damages which in no circumstance whatsoever will exceed the price of the Goods.

Waiver
Nothing in these Terms and Conditions and no express or implied waiver by the Supplier in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

Force Majeure
The Supplier shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, accidents, war, fire, strikes, lock outs, failure of any communications including telecommunications or computer systems, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Supplier shall be entitled to a reasonable extension of its obligations.

Invalidity and severance
Each clause or any part at all of these Terms and Conditions is to be regarded as independent of the others. This means that should any clause or any part at all of these Terms and Conditions be found to be unenforceable or invalid it will be severed and will not affect the enforceability or validity of the rest of these Terms and Conditions.

Governing law and jurisdiction
These Terms and Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
